Entry to Seagate Precious Memories Competition is open to all journalists, photo journalists and professional bloggers who are of legal age of majority in the jurisdiction in which they reside (and at least over the age of 18 years) as of 1st June 2008 and who reside in one of the countries that the competition is being held. Sponsor reserves the right to verify the eligibility of any entrant.

To enter, eligible entrants must submit an original digital work that meets the outlined technical specifications in one of the two categories (photography or video), provide a title and description (maximum 50 words) of their entry and their contact details including date of birth on the registration page located at http://www.seagatememories.com/ between 9am Thursday 3rd July 2008 (local time) and 5pm on Thursday 17th July 2008 (local time). The sole determinant of time for the purposes of the competition will be the Promoter's servers.

Entrant hereby consents that, for the purpose of facilitating in competition, the Promoter may collect, computerize, worldwide transmit and employ the personal data disclosed by such entrant.

Photos must be submitted in one of the following file extensions: .gif .jpg .jpeg. Videos must be submitted on one of the following formats: .mov .avi .flv. Photos and videos cannot exceed 2Mb (photos) and 8Mb (video). Videos can be no longer than three minutes. There is a limit of one entry per category per person.

Entrants may only enter the Seagate Precious Memories Competition in one of the countries from the list provided below - the country in which they currently reside in at time of entry.
Seagate Precious Memories will consist of ten National competitions and one Regional final competition which includes the 1st, 2nd and 3rd place winners of the National competitions. A National competition will be run in Australia, New Zealand, India, Malaysia, Thailand, Hong Kong, China, Korea, Taiwan and Singapore.

Employees of the Promoter and its agents and their immediate family members are not eligible to enter.

This is a contest of skill and chance plays no part in determining the winners.

All entries must be the original work of the entrant. By submitting their entry, the entrant:

Warrants that the entrant's submission and digital work is original and does not infringe the rights of any third party;

Agrees that if their entry is later found to have breached or infringed copyright or rights of any third party, they will assume full legal and moral responsibility for their entry and breach and indemnify the Promoter against any claims arising in relation to their entry in this competition. Additionally if their entry was selected to win they agree to return, at their own cost, to the Promoter all prizes (cash and product) received;

Grants to the Promoter and its agents a worldwide, perpetual, irrevocable, right and royalty-free licence to make use of any copyright material contained in the entrant's submission, including the entrant's digital work, including without limitation the right to copy, duplicate, alter and modify in whole or in part, in any and all media, the entrant's submission for the following purposes:

operating, administering and promoting the competition;

displaying the entrant's submission on this competition website and/or the Promoter's website;

issuing a media release with images regarding the winning entries.

Consents to the doing of any acts by the Promoter in connection with the competition which would otherwise infringe any moral rights which the entrant or his/her descendants may have in the works submitted during the entry process.

The Promoter reserves the right to take down and disqualify any entry which it believes, in its sole discretion, is offensive or in breach of any defamation, copyright, privacy or other laws in each of the 10 countries involved in this competition. In this instance the entrant will be informed of the decision and will have the right to submit an alternative and appropriate entry in its place so long as it does so before the relevant country competition closes at 5pm (local time) on Thursday 17th July 2008. The sole determinant of time for the purposes of the competition will be the Promoter's servers.

The Promoter accepts no responsibility for late entries or entries not received for any reason within the stipulated date and time through no fault of Promoter.

The 1st, 2nd and 3rd place winners in each category of each National competition will be the three valid entries that have received the most unique, human generated votes online during the voting period which will commence on 9am Thursday 3rd July 2008 and run until 5pm Thursday 24th July 2008 (local time for each national competition). In the event of a tie-breaker, the Seagate Asia Pacific Corporate Communications Director will make the final decision based on assessment of the creativity and originality of the entries.

Following the online voting three winners (1st, 2nd and 3rd place) will be awarded in each category for each National competition. These winners will advance to the Regional competition.

The Regional winners (1st, 2nd and 3rd) in each category will be those that are voted by a Seagate selected judging panel to be the most creative and original entries in each of the two categories.

National competition winners will receive the following prizes: Photo category 1st prize - Seagate® FreeAgent™ Pro 750GB drive plus the equivalent of US$500; 2nd prize - Maxtor® OneTouch 4™ 500GB drive plus the equivalent of US$200; and 3rd prize FreeAgent Go 160GB drive plus the equivalent of US $100. Video category 1st prize - FreeAgent Pro 750GB drive plus the equivalent of US$1000; 2nd prize - Maxtor OneTouch 4 500GB drive plus the equivalent of US$500; and 3rd prize FreeAgent Go 160GB drive plus the equivalent of US $200.

Regional competition winners will receive the following prizes: Photo category 1st prize - FreeAgent Pro 1TB drive plus the equivalent of US$1000; 2nd prize - Maxtor OneTouch 4 750GB drive plus the equivalent of US$500; and 3rd prize FreeAgent Go 250GB drive plus the equivalent of US $200. Video category 1st prize -FreeAgent Pro 1TB drive plus the equivalent of US$2000; 2nd prize - MaxtorOne Touch 4 750GB drive plus the equivalent of US$1000; and 3rd prize FreeAgent Go 250GB drive plus the equivalent of US $500.

All cash prizes will be awarded in the currency of the country in which each place winner entered. All prize values will be calculated using the value of the US dollar as at the date on which the prize winners are determined.

National and Regional competition winners will need to provide proof of identity in accordance with the details provided at time of entry to receive the prizes.

In the event that the Promoter is unable to supply any prize, the Promoter reserves the right to supply an alternative prize of similar monetary value.

The Promoter accepts no responsibility for and will not be liable for any tax implications that may arise from winning and receiving any prize. All taxes associated with the winning and receiving any prize (including any taxes imposed by customs) are the sole responsibility of the winners.

The Promoter will not be liable for any loss or damage (other than personal injury or death caused by the negligence of any of the Released Parties) (including but not limited to indirect or consequential loss) which is suffered or sustained, as a result of participation in the competition or receiving and taking any prize, except for any liability which cannot be excluded by law.

National Competition Winners will be announced via email and media alert on 4th August 2008.

Regional Competition Winners will be announced via email and media alert on 18th August 2008.

Prizes will be dispatched to all winners as soon as practicable following the announcement of the winners to the address provided at time of entry. Once the prize has been dispatched, any risk and property to the prizes will be passed to the winners.

Prizes are not transferable and no substitutions or exchanges (including for cash) of any prize will be permitted, except that Promoter reserves the right to substitute a prize of equal or greater value for any prize.

Online voting in each national competition is open to any person who registers fully and accurately at http://www.seagatememories.com/ by following the directions provided.

To keep it fair and avoid multiple voting, we will only register only the first vote in each category for each voter. Where additional votes are made all subsequent votes will not be counted.

At the end of the online voting in each National competition, one registered voter who voted for the winning entry (1st prize) in each category will be selected at random and if they have correctly answered a question online at the time of voting they will receive a Maxtor OneTouch 4 Mini.

Employees and their immediate families of the Promoter and agencies associated with this promotion are ineligible to vote.

For the avoidance of doubt, nothing in the rules shall deem the relationship between the client and the winners as that of a seller and consumers.

The Promoter takes no responsibility for lost, damaged, misdirected, late or illegible entries, incorrect or inaccurate transcription of entry information or votes, or for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access telecommunications or internet network services, or any other error or malfunction.

The Promoter's decision is final on all matters and no correspondence will be entered into. Entry into this competition will be deemed to be an acceptance of the above terms and conditions.

The Promoter reserves the right to amend any aspect of this competition at any time in its sole discretion.

The Promoter reserves the right to verify the validity of any entry and to disqualify any entrant or voter for tampering with the entry or voting process or attempting to act in a fraudulent or otherwise dishonest manner.

The Promoter takes no responsibility for disputes arising as a result of entries submitted or votes lodged using an email address belonging to any other person.

The Promoter collects and holds personal information provided with each entry and vote to be used for the purposes of running the competition and in particular to notify prize winners and to verify prize winners' identities. All personal information provided by entrants and voters will be held by Einsteinz Communications at 38 Albany Street, St Leonards NSW 2065 AUSTRALIA. Entrants and voters have the right to access and correct their personal information by emailing the Promoter at seagatepr@einsteinz.com.au. The Promoter will destroy all records of personal information once all prizes have been dispatched, with the exception of entrants name and publication; and the full details of those individuals who have indicated that they wish to join the Promoter's mailing list.

As a condition of accepting any prize, winners agree to be available for reasonable publicity purposes without further compensation, including but not limited to photographs and interviews. Winners acknowledge that their personal details may be published in newspapers, magazine and on the internet.

Should any portion of the competition be, in Promoter's sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Promoter, corrupt or impair the administration, security, fairness or proper play, or submission of entries or votes, Promoter reserves the right at its sole discretion to suspend, modify or terminate the competition (or any portion thereof) and, if terminated, at its discretion, select the potential winner(s) for the portion(s) at issue from all eligible, non-suspect entries received prior to action taken using the winner determination procedures set forth above or as otherwise deemed fair and appropriate by Promoter.

Any disputes shall be resolved by Promoter in its sole discretion. Promoter's decisions are final and binding in all matters relating to this competition.

The competition and these rules will be governed, construed and interpreted under the laws of the State of California, United States.
